Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 6 Offences relating to property and contractsChapter 42A Secret commissions[s 442J]or any part thereof, and such order shall be enforceablein the same manner as an order of the court.442JCourt may order withdrawal of trifling or technical casesIf in any prosecution under this chapter it appears to the courtthat the offence charged is, in the particular case, of a triflingor merely technical nature, or that in the particularcircumstances it is inexpedient to proceed to a conviction, thecourt may in its discretion, and for reason stated on theapplication of the accused, dismiss the case; but the courtmay, if it thinks fit, make the order mentioned in section 442I.442K Witness giving answers criminating himself or herself(1) A person who is called as a witness in any proceeding underthis chapter shall not be excused from answering any questionrelating to any offence against this chapter on the ground thatthe answer thereto may criminate or tend to criminate theperson.(2) An answer to a question in any such proceeding shall not,except in the said proceeding or in the case of any prosecutionfor perjury in respect of such answer, be in any proceeding,civil or criminal, admissible in evidence against the person soanswering.442LCertificate to witness(1) A witness in any proceeding under this chapter who, in thejudgment of the court, answers truly all questions which thewitness is required by the court to answer shall be entitled toreceive a certificate from the court stating that such witnesshas so answered.Stay of proceedings against such witness(2) When a person has received a certificate as aforesaid, and anycriminal proceeding is at any time instituted against theperson in respect of the offence which was in question in theCurrent as at 1 December 2014 Page 269
