Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 2 Offences against public orderChapter 8 Offences against the executive and legislative power[s 54A](4) If the carrying out of the threat would be likely to cause—(a) loss of life or serious personal injury to any person; or(b) substantial economic loss—(i) to the Crown; or(ii) to a government corporation; or(iii) in any industrial or commercial activity whetherconducted by a public authority or as a privateenterprise;the offender is liable to imprisonment for life and if, inaddition, the offender or another person on the offender’sbehalf has carried out the threat and thereby caused aconsequence specified in this subsection or has by some overtact begun to prepare for the carrying out of the threat, theoffender is liable to imprisonment for life, which can not bemitigated or varied under this <strong>Code</strong> or any other law or isliable to an indefinite sentence under part 10 of the Penaltiesand Sentences <strong>Act</strong> 1992.(5) A prosecution for an offence defined in this section shall notbe commenced without the consent of the Attorney-General.(6) For the purposes of this section—detriment includes destruction of or damage to—(a) flora or fauna protected by or under an <strong>Act</strong>; or(b) any place, thing or living creature or plant that by reasonof its cultural, educational, environmental, historical,recreational, religious or scientific significance is ofsubstantial public interest or concern;and, in the absence of proof that any such item destroyed ordamaged was or is the property of a particular person, shall bedeemed to be detriment to the Crown.government corporation means any body corporate orcorporation sole constituted by or under an <strong>Act</strong> that representsthe Crown or that is declared under a regulation to be agovernment corporation for the purposes of this section.Page 64 Current as at 1 December 2014
