Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 58A Indictable offences dealt with summarily[s 552C]Column 1 Column 2 Column 3Provision of <strong>Code</strong> Provision heading Relevant circumstancesection 514 Personation in general The offender is liable toimprisonment for 14 years, the valueof the property mentioned in section514(2) is equal to or more than theprescribed value and the offenderdoes not plead guilty.552C Constitution of Magistrates Court(1) A Magistrates Court that summarily deals with an indictableoffence under this chapter must be constituted by—(a) a magistrate; or(b) justices appointed under subsection (3) for the place atwhich the Magistrates Court is being held.(2) Jurisdiction of the justices mentioned in subsection (1)(b) islimited to an offence—(a) that is dealt with on a plea of guilty; and(b) that the justices consider they may adequately punish bythe imposition of a penalty not more than the maximumpenalty they may impose under section 552H; and(c) for an offence involving property—that involvesproperty, or property damage or destruction, of a valuenot more than $2500.(3) For subsection (1)(b), the Attorney-General may by gazettenotice appoint a justice for a place specified in the gazettenotice.(4) A justice appointed under subsection (3) must be a justice ofthe peace (magistrates court) who the Attorney-General issatisfied has appropriate qualifications.(5) A gazette notice may only specify a place appointed forholding a Magistrates Court—Page 330 Current as at 1 December 2014
