Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 5 Offences against the person and relating to marriage and parental rights and dutiesChapter 34 Offences relating to marriage and parental rights and duties[s 361](a) being married, goes through the form of marriage withany other person during the life of his or her wife orhusband; or(b) goes through the form of marriage with any personwhom he or she knows to be married;is guilty of a crime, and is liable to imprisonment for 7 years.(2) It is a defence to a charge of either of the offences defined inthis section to prove that at the time of committing the allegedoffence the wife or husband of the person already married hadbeen continually absent from him or her for the space of 7years then last past, unless it is shown that the accused personknew that such wife or husband was living within that time.361 Unlawful celebration of marriageAny person who—(a) celebrates, or attempts or professes to celebrate, themarriage of any person who, to the person’s knowledge,is under the age of 18 years, and is not a widower orwidow, without the written consent of some personauthorised by law to give such consent, or with a writtenconsent which, to the person’s knowledge, is not givenby a person authorised by law to give it; or(b) celebrates, or attempts or professes to celebrate, anymarriage contrary to the provisions of the laws relatingto the solemnisation of marriage; or(c) celebrates, or attempts or professes to celebrate, anymarriage in any case in which any provision of thoselaws has not been complied with, knowing that it has notbeen complied with; or(d) induces, or attempts to induce, any person to celebratethe marriage of any person who is to the knowledge ofthe offender under the age of 18 years, and is not awidower or widow, without the consent mentioned inparagraph (a), or with a consent which, to the person’sPage 226 Current as at 1 December 2014
