Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 14 Corrupt and improper practices at elections[s 102]Maximum penalty—1 year’s imprisonment.(3) In this section—election conduct of a person means—(a) the person’s voting or not voting at an election; or(b) the way in which the person votes at an election; or(c) the person’s nominating as a candidate for an election;or(d) the person’s support of, or opposition to, a candidate atan election.give includes promise and offer to give.102 Publishing false information about a candidateA person who, before or during an election, in order to affectthe election result, knowingly publishes false informationabout—(a) a candidate’s personal character or conduct; or(b) whether a candidate has withdrawn from the election;commits a misdemeanour.Maximum penalty—1 year’s imprisonment.103 Providing money for illegal paymentsA person who knowingly provides money—(a) for a payment that is contrary to this chapter division orthe authorising <strong>Act</strong> for an election; or(b) to replace money that has been spent in making apayment mentioned in paragraph (a);commits an offence.Maximum penalty—10 penalty units.Current as at 1 December 2014 Page 93
