Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 61 Effect of indictment[s 582](b) fraud, with or without a circumstance of aggravation;(c) obtaining from any other person any chattel, money orvaluable security by passing a cheque that is not paid onpresentation for payment;(d) unlawful use or possession of a vehicle, with or withouta circumstance of aggravation;(e) unlawfully receiving anything under section 433;(f) counselling or procuring any other person to commitany of such offences;the person may be convicted of any other of such offencescommitted with respect to the same property, if such otheroffence is established by the evidence.582 Charge of procuring commission of offence or wrongfulact(1) Upon an indictment charging a person with procuring thecommission of any offence, the person may be convicted ofprocuring the commission of any other offence of such anature that a person may be convicted of it upon an indictmentcharging the person with committing the offence of which theaccused person is alleged to have procured the commission.(2) Upon an indictment charging a person with procuring anotherto do an act or make an omission of such a nature that if theaccused person had done the act or made the omission, theperson would have been guilty of an offence, the person maybe convicted of procuring that other person to do any other actor make any other omission which is established by theevidence, and which is of such a nature that if the accusedperson had done that act or made that omission the personwould have been guilty of an offence, such last-namedoffence being itself of such a nature that a person may beconvicted of it upon an indictment charging the person withcommitting the offence of which the accused person wouldhave been guilty if the person had done the act or made thePage 354 Current as at 1 December 2014
