Schedule 1 The Criminal CodePart 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 13 Corruption and abuse of office[s 87]Chapter 13Corruption and abuse of office87 Official corruption(1) Any person who—(a) being employed in the public service, or being theholder of any public office, and being charged with theperformance of any duty by virtue of such employmentor office, not being a duty touching the administration ofjustice, corruptly asks for, receives, or obtains, or agreesor attempts to receive or obtain, any property or benefitof any kind for himself, herself or any other person onaccount of anything already done or omitted to be done,or to be afterwards done or omitted to be done, by theperson in the discharge of the duties of the person’soffice; or(b) corruptly gives, confers, or procures, or promises oroffers to give or confer, or to procure or attempt toprocure, to, upon, or for, any person employed in thepublic service, or being the holder of any public office,or to, upon, or for, any other person, any property orbenefit of any kind on account of any such act oromission on the part of the person so employed orholding such office;is guilty of a crime, and is liable to imprisonment for 7 years,and to be fined at the discretion of the court.(1A) If the offence is committed by or in relation to a Minister ofthe Crown, as the holder of public office mentioned insubsection (1), the offender is liable to imprisonment for 14years, and to be fined at the discretion of the court.(2) The offender can not be arrested without warrant.88 Extortion by public officersAny person who, being employed in the public service, takesor accepts from any person, for the performance of thePage 80 Current as at 1 December 2014
