Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 4 <strong>Act</strong>s injurious to the public in generalChapter 22 Offences against morality[s 228F](iii) for a film—a certificate mentioned in theClassification of Films <strong>Act</strong> 1991, section 60(1)signed or purporting to be signed by the director orconvenor within the meaning of that <strong>Act</strong>.classification exemption means an exemption given under—(a) for a computer game—the Classification of ComputerGames and Images <strong>Act</strong> 1995, section 59; or(b) for a film—the Classification of Films <strong>Act</strong> 1991, section57 or 59A; or(c) for a publication—the Classification of Publications <strong>Act</strong>1991, section 37.228FExcluding non-essential persons from court when childexploitation material displayed(1) When material alleged to be child exploitation material is ondisplay in a courtroom, the court must exclude from thecourtroom anyone who is not an essential person.(2) An essential person is—(a) a party, or a person representing a party, to theproceeding; or(b) a Crown Law Officer or a person authorised by a CrownLaw Officer; or(c) the prosecutor; or(d) a witness giving evidence; or(e) a person who a witness is entitled to have present incourt under the Evidence <strong>Act</strong> 1977, section 21A(2)(d) or21AV or the <strong>Criminal</strong> Law (Sexual Offences) <strong>Act</strong> 1978,section 5(1)(f); or(f) a person whose presence is, in the court’s opinion,necessary or desirable for the proper conduct of theproceeding; orPage 140 Current as at 1 December 2014
