Schedule 1 The Criminal CodePart 6 Offences relating to property and contractsChapter 36 Stealing[s 398](c) the whole or part of the proceeds of any valuablesecurity which has been received by the offender with adirection that the proceeds thereof should be applied toany purpose or paid to any person specified in thedirection;(d) the whole or part of the proceeds arising from anydisposition of any property which have been received bythe offender by virtue of a power of attorney or otherauthority for the disposition of the property received bythe offender with a direction that such proceeds shouldbe applied to any purpose or paid to any personspecified in the direction;the offender is liable to imprisonment for 10 years.9 Stealing property valued at more than $5000If the thing stolen is property, including an animal that isstock, and its value is more than $5000, the offender is liableto imprisonment for 10 years.10 Stealing by tenants or lodgersIf the thing stolen is a fixture or chattel let to the offender tobe used by him or her with a house or lodging, and its valueexceeds $1000, the offender is liable to imprisonment for 10years.11 Stealing after previous convictionIf the offender, before committing the offence, had beenconvicted upon indictment of any of the indictable offencesdefined in this division, or had been twice previouslysummarily convicted of an offence punishable on summaryconviction under this division, whether each of theconvictions was in respect of an offence of the same characteror not, the offender is liable to imprisonment for 10 years.Current as at 1 December 2014 Page 241
