Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 6 Offences relating to property and contractsChapter 41 Receiving property stolen or fraudulently obtained and like offences[s 432]property, knowingly furnishes any false statement or return ofany money or property received by the person or entrusted tothe person’s care, or of any balance of money or property inthe person’s possession or under the person’s control, is guiltyof a misdemeanour, and is liable to imprisonment for 2 years.Chapter 41Receiving property stolen orfraudulently obtained and likeoffences432 What is tainted property for ch 41(1) In this chapter—tainted property means—(a) a thing that has been obtained by way of an actconstituting an indictable offence; or(b) if tainted property mentioned in paragraph (a) isconverted into other property—any of the otherproperty; or(c) if tainted property mentioned in paragraph (a) ismortgaged, pledged or exchanged for otherproperty—any of the proceeds of the mortgage, pledge,or exchange.(2) However, a thing stops being tainted property after a personacquires a lawful title to it.433 Receiving tainted property(1) A person who receives tainted property, and has reason tobelieve it is tainted property, commits a crime.Page 260 Current as at 1 December 2014
