Schedule 1 The Criminal CodePart 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 13 Corruption and abuse of office[s 91]special character, or respecting the carrying on of anymanufacture, trade, or business, of a special character, andhaving acquired or holding, directly or indirectly, a privateinterest in any such property, manufacture, trade, or business,discharges any such duties with respect to the property,manufacture, trade, or business, in which the person has suchinterest, or with respect to the conduct of any person inrelation thereto, is guilty of a misdemeanour, and is liable toimprisonment for 1 year, and to be fined at the discretion ofthe court.91 False claims by officialsAny person who, being employed in the public service in sucha capacity as to require the person or to enable the person tofurnish returns or statements touching any remunerationpayable or claimed to be payable to himself, herself or to anyother person, or touching any other matter required by law tobe certified for the purpose of any payment of money ordelivery of goods to be made to any person, makes a return orstatement touching any such matter which is, to the person’sknowledge, false in any material particular, is guilty of amisdemeanour, and is liable to imprisonment for 3 years.92 Abuse of office(1) Any person who, being employed in the public service, doesor directs to be done, in abuse of the authority of the person’soffice, any arbitrary act prejudicial to the rights of another isguilty of a misdemeanour, and is liable to imprisonment for 2years.(2) If the act is done or directed to be done for purposes of gain,the person is liable to imprisonment for 3 years.Page 82 Current as at 1 December 2014
