Schedule 1 The Criminal CodePart 8 ProcedureChapter 61 Effect of indictment[s 587]the person may be convicted of such last mentioned offence,and is liable to the same punishment as if the person had beensummarily convicted of that offence.587 Illegal practicesIf, on the trial of a person charged with an offence relating toelections and punishable on summary conviction, the evidenceestablishes that the person is guilty of an indictable offencerelating to elections, the person is not entitled to have thecharge dismissed if the evidence also establishes that theperson did any act or acts such as to constitute the offencewith which the person is actually charged.588 Charge of stealing stockIf, on the trial of a person charged with stealing an animal thatis stock, the evidence establishes that the person is not guiltyof the offence charged, but is guilty of any of the offencesfollowing, that is to say—(a) unlawfully using the animal without the consent of theowner, or of the person in lawful possession thereof;(b) branding or marking the animal, or knowinglypermitting it to be branded or marked, with the person’sregistered brand or registered mark, knowing that theperson is not the owner of the animal;(c) altering or defacing, or otherwise renderingundistinguishable, any registered brand or registeredmark upon the animal;(d) knowingly permitting any act as mentioned in paragraph(c) to be done by any person over whom the person hascontrol;the person may be convicted of the offence so established bythe evidence, and is liable to the same punishment as if theperson had been convicted of that offence.Current as at 1 December 2014 Page 357
