Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 1 IntroductoryChapter 3 Application of criminal law[s 15]omission, the person would have been guilty of an offenceunder the laws in force in the place where the act or omissionis done or made, is guilty of an offence of the same kind, andis liable to the same punishment, as if the act had been done orthe omission had been made in <strong>Queensland</strong>, but so that thepunishment does not exceed that which the person would haveincurred under the laws in force in the place where the act wasdone or the omission was made, if the person had done the actor made the omission.15 Defence ForceOfficers and other members of the Australian Defence Forceare, while on duty or in uniform, subject to the special lawsrelating to that Force, but are not exempt from the provisionsof this <strong>Code</strong>.16 Person not to be twice punished for same offenceA person can not be twice punished either under theprovisions of this <strong>Code</strong> or under the provisions of any otherlaw for the same act or omission, except in the case where theact or omission is such that by means thereof the personcauses the death of another person, in which case the personmay be convicted of the offence of which the person is guiltyby reason of causing such death, notwithstanding that theperson has already been convicted of some other offenceconstituted by the act or omission.17 Former conviction or acquittalIt is a defence to a charge of any offence to show that theaccused person has already been tried, and convicted oracquitted upon an indictment on which the person might havebeen convicted of the offence with which the person ischarged, or has already been acquitted upon indictment, or hasalready been convicted, of an offence of which the personPage 52 Current as at 1 December 2014
