Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 62 Trial—adjournment—pleas— practice[s 590F]disclosure obligation direction means a direction or rulingunder section 590AA(2)(ba), to the extent it relates tocompliance with a disclosure obligation.party, to a proceeding, means—(a) an accused person who is charged with an offence thesubject of the proceeding; or(b) the prosecution in relation to an offence the subject ofthe proceeding.prosecution has the same meaning it has in chapter division 3.590FSubject matter for disclosure obligation direction(1) A disclosure obligation direction may provide for any of thefollowing—(a) whether a party to a proceeding has a disclosureobligation in relation to another party to the proceeding;(b) requiring that a particular thing must be disclosed;(c) allowing the court to inspect a particular thing to decidewhether the court should further direct that a party has adisclosure obligation in relation to the thing;(d) allowing the court to examine the arresting officer todecide whether the prosecution has a disclosureobligation in relation to a particular thing;(e) requiring that the arresting officer file an affidavit toallow the court to decide whether the prosecution has adisclosure obligation in relation to a particular thing;(f) allowing the accused person or a lawyer acting for theaccused person to cross-examine the arresting officer onan affidavit mentioned in paragraph (e) to allow thecourt to decide whether the prosecution has a disclosureobligation in relation to a particular thing;(g) how a disclosure obligation is to be complied with in aparticular case;Current as at 1 December 2014 Page 393
