<strong>Criminal</strong> <strong>Code</strong> <strong>Act</strong> <strong>1899</strong>[s 4]4 Construction of statutes, statutory rules, and otherinstrumentsFrom and after the coming into operation of the <strong>Code</strong>, thefollowing rules shall apply with respect to the construction ofstatutes, statutory rules, by-laws, and other instruments, that isto say—(a) when in any statute, statutory rule, by-law, or otherinstrument, public or private, the term felony is used, orreference is made to an offence by the name of felony, itshall be taken that reference is intended to an offencewhich is a crime under the provisions of the <strong>Code</strong>;(b) when in any statute, statutory rule, by-law, or otherinstrument, public or private, the term murder is used, itshall be taken that reference is intended to the crimes ofwilful murder and murder and each of them;(c) when in any statute, statutory rule, by-law, or otherinstrument, public or private, the term larceny is used, itshall be taken that reference is intended to the crime ofstealing;(d) when in any statute, statutory rule, by-law, or otherinstrument, public or private, reference is made to anyoffence by any specific name, it shall be intended thatreference is intended to the offence which, under theprovisions of the <strong>Code</strong>, is constituted by the act oromission that would heretofore have constituted theoffence referred to;(e) when in any statute, statutory rule, by-law, or otherinstrument, public or private, reference is made to any ofthe statutory provisions hereby repealed, it shall betaken that reference is intended to the correspondingprovisions or substituted provisions of the <strong>Code</strong>.5 Provisions of <strong>Code</strong> exclusive with certain exceptionsFrom and after the coming into operation of the <strong>Code</strong>, noperson shall be liable to be tried or punished in <strong>Queensland</strong> asfor an indictable offence except under the express provisionsof the <strong>Code</strong> or some other statute law of <strong>Queensland</strong>, or underCurrent as at 1 December 2014 Page 29
