Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 16 Offences relating to the administration of justice[s 123A](6) It is immaterial whether the person who gives the testimony isa competent witness or not, or whether the testimony isadmissible in the proceeding or not.(7) The offender can not be arrested without warrant.123A Perjury—contradictory statementsIf, on the trial of a person for perjury, the jury is satisfiedthat—(a) the accused has made 2 statements on oath or underanother sanction authorised by law, 1 of which isirreconcilably in conflict with the other; and(b) the accused made 1 of the statements knowing it to befalse;but the jury is unable to say which statement was falselymade, the jury may make a special finding to that effect andfind the accused guilty of perjury.124 Punishment of perjury(1) Any person who commits perjury is liable to imprisonmentfor 14 years.(2) If the offender commits the crime in order to procure theconviction of another person for a crime punishable withimprisonment for life, the offender is liable to imprisonmentfor life.125 Evidence on charge of perjuryA person can not be convicted of committing perjury or ofcounselling or procuring the commission of perjury upon theuncorroborated testimony of 1 witness.Page 104 Current as at 1 December 2014
