Schedule 1 The Criminal CodePart 4 Acts injurious to the public in generalChapter 22A Prostitution[s 229J]229JCertificate of discharge for particular offences(1) In this section—defendant means a person charged with an unlawfulprostitution offence or an unlawful presence offence.identifying matter means—(a) the name, address, place of employment or anotherparticular of the defendant or another person that islikely to lead to the identification of the defendant; or(b) any photograph, picture, videotape or other visualrepresentation of the defendant or another person that islikely to lead to the identification of the defendant.the court means a court before which is brought a chargeagainst a defendant for an unlawful prostitution offence or anunlawful presence offence, and includes a justice conductingan examination of witnesses in relation to an unlawfulprostitution offence or an unlawful presence offence chargedagainst a defendant.unlawful presence offence means an offence against section229I.unlawful prostitution offence means an offence againstsection 229HC(1) or (2).(2) At any time before being found guilty of the unlawfulprostitution offence or the unlawful presence offence, thedefendant—(a) may apply to the court for the issue of the certificate ofdischarge mentioned in subsection (6) in relation to theunlawful prostitution offence or the unlawful presenceoffence; and(b) may apply to the court for an order prohibitingpublication of identifying matter in relation to thedefendant if the certificate is granted.(3) The application may be heard in court or in chambers.Current as at 1 December 2014 Page 155
