Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 6 Offences relating to property and contractsChapter 41 Receiving property stolen or fraudulently obtained and like offences[s 435]Maximum penalty—(a) if the property was obtained by way of an actconstituting a crime—14 years imprisonment; or(b) if the property is a firearm or ammunition—14 yearsimprisonment; or(c) if the offender received the property while acting as apawnbroker or dealer in second hand goods, under alicence or otherwise—14 years imprisonment; or(d) otherwise—7 years imprisonment.(2) For the purpose of proving the receiving of anything it issufficient to show that the accused person has, either alone orjointly with some other person, had the thing in his or herpossession, or has aided in concealing it or disposing of it.435 Taking reward for recovery of property obtained by wayof indictable offencesIf—(a) a thing is obtained by way of any act constituting anindictable offence; and(b) a person dishonestly receives, or dishonestly agrees toreceive, any benefit on an agreement or understandingthat the person will help anyone to recover the thing;then, unless the person has used all due diligence to cause theoffender to be brought to trial for the offence, the personcommits a crime.Maximum penalty—7 years imprisonment.Current as at 1 December 2014 Page 261
