Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 69 Seizure and detention of property connected with offences—restitution ofproperty unlawfully acquired[s 679A](3) The relevant court may make an order authorising publicationonly if the court is satisfied that it is in the interests of justiceto make the order.(4) Before making an order under this section, the relevant courtmust give the acquitted person a reasonable opportunity to beheard on the application for the order.(5) The relevant court may at any time vary or revoke an orderunder this section.(6) The prohibition on publication under this section ceases tohave effect, subject to any order under this section, when thefirst of the following paragraphs apply—(a) there is no longer any step that could be taken whichwould lead to the acquitted person being retried underthis chapter;(b) if the acquitted person is retried under this chapter—thetrial ends.(7) Nothing in this section affects any prohibition of thepublication of any matter under any other <strong>Act</strong> or law.(8) A contravention of a prohibition on publication under thissection is punishable as contempt of the Supreme Court.Chapter 69Seizure and detention ofproperty connected withoffences—restitution ofproperty unlawfully acquired679A Search of aircraft(1) If it appears to the person in command of an aircraft that thereare reasonable grounds for suspecting that any offenceinvolving the safety of the aircraft has been, is being, is aboutto be, or may be, committed on board or in relation to thePage 456 Current as at 1 December 2014
