Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 2 Offences against public orderChapter 9 Breaches of the peace[s 60B](c) a person who (whether by words or conduct, or in anyother way) seeks to be a member of, or to be associatedwith, the organisation; or(d) a person who attends more than 1 meeting or gatheringof persons who participate in the affairs of theorganisation in any way; or(e) a person who takes part in the affairs of the organisationin any other way;but does not include a lawyer acting in a professional capacity.public place means—(a) a place, or part of a place, that the public is entitled touse, is open to members of the public or is used by thepublic, whether or not on payment of money; or(b) a place, or part of a place, the occupier of which allows,whether or not on payment of money, members of thepublic to enter.60BParticipants in criminal organisation entering prescribedplaces and attending prescribed events(1) Any person who is a participant in a criminal organisation andenters, or attempts to enter, a prescribed place commits anoffence.Minimum penalty—6 months imprisonment served wholly ina corrective services facility.Maximum penalty—3 years imprisonment.(2) Any person who is a participant in a criminal organisation andattends, or attempts to attend, a prescribed event commits anoffence.Minimum penalty—6 months imprisonment served wholly ina corrective services facility.Maximum penalty—3 years imprisonment.Current as at 1 December 2014 Page 71
