Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 14 Corrupt and improper practices at elections[s 104]104 Election notices to contain particular matters(1) A person who, before or during an election, prints orpublishes, or permits another person to print or publish, anelection notice for the election that does not state the nameand address of the person who authorised the notice commitsan offence.Maximum penalty—3 penalty units.(2) In this section—address means address other than a post office box.election notice means a notice containing anything able to, orintended to—(a) influence an elector in relation to voting in an election;or(b) affect the result of an election.notice includes a poster, handbill and pamphlet.publish includes publish on the internet, even if the internetsite on which the publication is made is located outside<strong>Queensland</strong>.107 Corrupt and illegal practices—time(1) A prosecution for any of the offences defined in sections 99 to104 must be begun within 1 year after the offence iscommitted.(2) The service or execution of process on or against the allegedoffender is deemed to be the commencement of theprosecution, unless such service or execution is prevented bysome act on the person’s part, in which case the issue of theprocess is deemed to be the commencement of theproceeding.Page 94 Current as at 1 December 2014
