<strong>Criminal</strong> <strong>Code</strong> <strong>Act</strong> <strong>1899</strong>EndnotesSection 16 the <strong>Criminal</strong> <strong>Code</strong> and Another <strong>Act</strong> Amendment <strong>Act</strong> 1990 provides—16 Transitional(1) Subject to subsection (2), a person who before thecommencement of this <strong>Act</strong> commits—(a) an offence defined in sections 208 (1) or (3) of The<strong>Criminal</strong> <strong>Code</strong> as it exists immediately before thecommencement; or(b) an offence defined in section 209 or 535 of The<strong>Criminal</strong> <strong>Code</strong> constituted by an attempt to commit anoffence defined in paragraph (a);cannot thereafter be convicted of the offence unless it iscommitted in respect of a person not an adult within themeaning of The <strong>Criminal</strong> <strong>Code</strong>(3) A person who, before the commencement of this <strong>Act</strong> commitsan offence defined in section 211 of The <strong>Criminal</strong> <strong>Code</strong> as itexisted immediately before the commencement, cannotthereafter be convicted of the offence.(4) A provision of this section stating that a person cannot beconvicted after the commencement of this <strong>Act</strong> of an offencedefined in a specified section of The <strong>Criminal</strong> <strong>Code</strong>committed before the commencement does not have the effectthat such a person cannot be charged convicted and punishedfor an offence defined in some other section of The <strong>Criminal</strong><strong>Code</strong> where the circumstances in question constitute anoffence defined in that other section.© State of <strong>Queensland</strong> 2014Authorised by the Parliamentary CounselCurrent as at 1 December 2014 Page 581
