Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 2 Offences against public orderChapter 9 Breaches of the peace[s 60C](3) It is a defence to a charge of an offence against subsection (1)or (2) to prove that the criminal organisation is not anorganisation that has, as 1 of its purposes, the purpose ofengaging in, or conspiring to engage in, criminal activity.(4) In this section—participant, in a criminal organisation, see section 60A.prescribed event means an event declared under a regulationto be a prescribed event.prescribed place means a place declared under a regulation tobe a prescribed place.60CParticipants in criminal organisation recruiting personsto become participants in the organisation(1) Any person who is a participant in a criminal organisation andrecruits, or attempts to recruit, anyone to become a participantin a criminal organisation commits an offence.Minimum penalty—6 months imprisonment served wholly ina corrective services facility.Maximum penalty—3 years imprisonment.(2) It is a defence to a charge of an offence against subsection (1)to prove that the criminal organisation is not an organisationthat has, as 1 of its purposes, the purpose of engaging in, orconspiring to engage in, criminal activity.(3) In this section—criminal organisation does not include a criminalorganisation under the <strong>Criminal</strong> Organisation <strong>Act</strong> 2009.participant, in a criminal organisation, see section 60A.recruit, a person, to become a participant in a criminalorganisation, includes counsel, procure, solicit, incite andinduce the person, including by promoting the organisation, tobecome a participant in the organisation.Page 72 Current as at 1 December 2014
