Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 6 Offences relating to property and contractsChapter 38 Stealing with violence—extortion by threats[s 414]414 Demanding property with menaces with intent to stealAny person who, with intent to steal anything, demands itfrom any person with threats of any injury or detriment of anykind to be caused to the other person, either by the offender orby any other person, if the demand is not complied with, isguilty of a crime, and is liable to imprisonment for 3 years.415 Extortion(1) A person (the demander) who, without reasonable cause,makes a demand—(a) with intent to—(i) gain a benefit for any person (whether or not thedemander); or(ii) cause a detriment to any person other than thedemander; and(b) with a threat to cause a detriment to any person otherthan the demander;commits a crime.Maximum penalty—(a) if carrying out the threat causes, or would be likely tocause, serious personal injury to a person other than theoffender—life imprisonment; or(b) if carrying out the threat causes, or would be likely tocause, substantial economic loss in an industrial orcommercial activity conducted by a person or entityother than the offender (whether the activity isconducted by a public authority or as a privateenterprise)—life imprisonment; or(c) otherwise—14 years imprisonment.(2) It is immaterial that—(a) the demand or threat is made in a way ordinarily used toinform the public rather than a particular person; orCurrent as at 1 December 2014 Page 253
