Page 8 <strong>of</strong> 15TRANSFERS (CONT.)An <strong>of</strong>fender is placed on probation in the county and placed in an ISF in another jurisdiction.Does the county code this <strong>of</strong>fender as “Transferred-Out” or is it coded as “Indirect-Incarcerated?Since the jurisdiction operating the ISF is carrying the <strong>of</strong>fender as Direct while they are in theISF, the county should carry this person as an “intra-state transfer out” (Item I.B.1) even thoughthe case has not technically been transferred. This is to avoid duplication in statewide totals.A CSCD has <strong>of</strong>fenders who work and reside in a satellite county and are put on probation inthe satellite county. However, <strong>of</strong>fenders report to their CSOs in the chief county as they areon a specialized caseload that is only available in the chief county. Can they (a) count<strong>of</strong>fenders as direct in the chief county and (b) as indirect Transfer within CSCD in thesatellite?Yes. CSCDs may maintain direct supervision <strong>of</strong> <strong>of</strong>fenders living and/or working in adjoiningjurisdictions if the CSCD has documented approval from the adjoining jurisdictionsAn <strong>of</strong>fender was transferred to another jurisdiction (County 2) so the county <strong>of</strong> originaljurisdiction was carrying this person as Indirect Transfer Out. The <strong>of</strong>fender got arrested andis currently in jail in County 2 for the new charge. County 2 returned courtesy supervision forthe original charge to the county <strong>of</strong> original jurisdiction and is carrying the <strong>of</strong>fender asIndirect-Incarcerated on the new charge. How should the county <strong>of</strong> original jurisdiction countthis <strong>of</strong>fender?Both counties should carry this <strong>of</strong>fender as Indirect—Incarcerated in County Jail (Item I.B.5.a).We transferred an <strong>of</strong>fender to Louisiana and have been counting him as an InterstateTransfer (out). Since in Louisiana, the <strong>of</strong>fender committed new <strong>of</strong>fenses and wasincarcerated in Louisiana prison. How should we count him?Count the <strong>of</strong>fender as an “Indirect, Other” (Item I.B.6) until his <strong>Texas</strong> Case terminates, or hereturns to your jurisdiction.An <strong>of</strong>fender is transferred-out from one county to another jurisdiction (either intra-state orinter-state). Can the county immediately code this as “Transferred Out” on the MCSCR? Thecounty would like to count all pending transfers as “Indirect-Other” until they receive eitheran acceptance or rejection letter from the receiving jurisdiction, at which point they wouldcarry the <strong>of</strong>fender as either a “Transfer-Out” or as “Report by Mail.”<strong>CJAD</strong> does not have a problem if the county wants to count pending transfers out as “IndirectOther” (Item I.B.6) until they have confirmation <strong>of</strong> acceptance or rejection. However, for intrastatetransfers, if the receiving jurisdiction is carrying the <strong>of</strong>fender as direct—the Originaljurisdiction must carry the <strong>of</strong>fender as a “Transfer-Out” (Item I.B.1) – otherwise statewidecounts <strong>of</strong> probationers will include duplicates.- 30 ­
