Policies and ProceduresIncreased funding by the 80 th Legislature has been accompanied by increased accountabilityrequirements. The <strong>Texas</strong> legislature and the <strong>Texas</strong> <strong>Department</strong> <strong>of</strong> <strong>Criminal</strong> <strong>Justice</strong> utilize datareported by CSCDs to evaluate the effectiveness <strong>of</strong> new funding provided. This is accomplishedby:• Performance Measures established by the <strong>Texas</strong> Legislature that must be reported to theLegislative Budget Board (LBB) on a quarterly basis• Annual Reports to the Governor and the LBB on monitoring <strong>of</strong> community supervisiondiversion funds• <strong>Data</strong> provided by departments, through the MCSCR and CSTS, utilized for calculatingfunding allocations and evaluating the efficacy <strong>of</strong> programs funded for public safety anddiversion purposes.To insure that this information is provided to the legislature in a timely basis the 80 th <strong>Texas</strong>legislature passed Rider 85, which states:The <strong>Department</strong> <strong>of</strong> <strong>Criminal</strong> <strong>Justice</strong> (<strong>TDCJ</strong>) may withhold the distribution<strong>of</strong> funds allocated in Goal A, Provide Prison Diversions, to communitysupervision and corrections departments (CSCDs) that fail to comply with<strong>TDCJ</strong> data reporting requirements that include, but are not limited to, datarequired for the Community Supervision Tracking System, QuarterlyFinancial Reports, Monthly Community Supervision and CorrectionReports, Caseload Reports, Program Output reports and other data requiredby <strong>TDCJ</strong> for accountability purposes.A committee composed <strong>of</strong> CSCD and <strong>TDCJ</strong>-<strong>CJAD</strong> representatives will draft proposed rulesdetailing policies and procedures to govern the use <strong>of</strong> application <strong>of</strong> Rider 85. These will beproposed as a rule to be adopted by the <strong>Texas</strong> Board <strong>of</strong> <strong>Criminal</strong> <strong>Justice</strong> and, if approved by theBoard, will be posted in the <strong>Texas</strong> Register for review and comment before submission for finaladoption by the Board.<strong>Data</strong> Compliance LogThe <strong>Data</strong> Compliance Log is used by the Research and Evaluation Unit to track data submissionsprovided by the CSCDs. For data requests and required reports/surveys, this system tracks if theCSCD:• Submitted data on or before the deadline• Submitted the data after the deadline• Refused to participate after being contacted and asked to submit the data• Submitted the data but with errors• Could not be contacted after the deadline by email or phone• Corrected or made reasonable attempts to correct any errors identify by <strong>CJAD</strong>- 3 ­
