Declaration Against John Andrew 1800<br />

Summon as Assize hereto not exceeding the number <strong>of</strong> forty five persons<br />

Together with such witnesses as best know the verity <strong>of</strong> the premises whose<br />

Names shall be given to you in a list Subscribed the said Complainers All to<br />

compear before our said Lords, day and place foresaid. The said persons <strong>of</strong><br />

Inquest to pass upon the Assize <strong>of</strong> the said John Andrew and Robert Ramsay to<br />

bear, leal and soothfast. Witnessing in so far as they know or shall be asked at<br />

them anent the said John Andrew & Robert Ramsay their guiltiness <strong>of</strong> the<br />

Crimes libelled, Ilk Witness and Assizes under the pain <strong>of</strong> one hundred merks<br />

Scots – According to Justice – As ye will answer to us thereupon. The which to<br />

do we commit to you full power by these our letters delivering them by you duly<br />

executed and indorsed Again to the bearer Given under our signet at Edinburgh<br />

the twenty sixth day <strong>of</strong> August in the fortieth year <strong>of</strong> our Reign 1800.<br />

Exculpation for John Andrew and Robert Ramsay By His Majesty’s Advocate<br />

That they are Criminally pursued at the Instance <strong>of</strong> our Advocate for our Interest<br />

for the Crime <strong>of</strong> Sedition and others in Manner Mentioned in the Criminal libel<br />

raised Against them there anent. The diet where<strong>of</strong> is fixed before our Lord<br />

Justice General, Lord Justice Clerk, and Lord Commissioners <strong>of</strong> Justiciary in a<br />

Circuit Court <strong>of</strong> Justiciary to be holden by them or any one or more <strong>of</strong> their<br />

Number within the Criminal Courthouse <strong>of</strong> Ayr to the Seventeenth day <strong>of</strong><br />

September Instant And that the Complainers have Sundry relevant defences to<br />

propose against the said libel for eliding there<strong>of</strong>; And also Sundry relevant<br />

exceptions and Objections to propose Against the Witnesses and Assizers<br />

where<strong>of</strong> they will be heavily prejudged by the peremptory diets <strong>of</strong> the Circuit<br />

Court unless remeid be provided thereto As is alledged.<br />

Our will is herefore and we Charge you That on Sight here<strong>of</strong> ye pass<br />

And in our Name and Authority lawfully summons, warn and Charge such<br />

witnesses As best know the verity <strong>of</strong> the premises whose names shall be given to<br />

you in a list Subscribed by the said Complainers, Or either <strong>of</strong> them, personally,<br />

or at their dwelling places, All to compear before our said Lords in a Circuit<br />

Court <strong>of</strong> Juiticiary to be holden by them or any One or More <strong>of</strong> their Number<br />

within the Criminal Court house <strong>of</strong> Ayr upon the said Seventeenth day <strong>of</strong><br />

September Instant, in the hour <strong>of</strong> cause, there to bear, leal and soothfast<br />

witnessing in so far as they know or shall be asked at them current the said John<br />

____ Andrew and Robert Ramsay their Innocence and exculpation <strong>of</strong> the Crimes<br />

libelled, Ilk Witness under the pain <strong>of</strong> One Hundred Merks Scots – According to<br />
