8. Execution <strong>of</strong> Witnesses in Criminal Witnesses/ The Majesties Advocate<br />

Against Andrew & Ramsay<br />

Upon the first day <strong>of</strong> September Eighteen Hundred years John Blacklock<br />

Messenger at Arms passed at Command <strong>of</strong> Criminal Letters raised at the<br />

instance <strong>of</strong> Robert Dundas Esquire <strong>of</strong> Arniston His Majesties advocate for his<br />

Majesties Interest against John Andrew Shoemaker in Maybole and sometime<br />

Schoolmaster there and Robert Ramsay Cartwright there And by Virtue there<strong>of</strong><br />

in his majesties name and authority Commanded and Charged the said John<br />

Andrew and Robert Ramsay To Compear and Come and find sufficient Caution<br />

and Surety acted in the Books <strong>of</strong> adjournal that they shall Compear before the<br />

Lord Justice General, Lord Justice Clerk and Lords Commissioners <strong>of</strong> Justiciary<br />

in a circuit Court <strong>of</strong> Justiciary to be holden by them or any one or more <strong>of</strong> their<br />

Number within the Tollbooth or Criminal Courthouse <strong>of</strong> Ayr upon the<br />

Seventeenth day <strong>of</strong> September Current in the hour <strong>of</strong> Cause thereto underlie the<br />

law for the Crimes mentioned in the said Criminal Letters and that within the<br />

space under the pains and made Certification as is therein expressed. This I did<br />

after the form and tenor <strong>of</strong> the said Criminal letters in all points which are dated<br />

and Signeted at Edinburgh the twenty Sixth day <strong>of</strong> August last By delivering to<br />

the said John Andrew & Robert Ramsay and each <strong>of</strong> them a full double <strong>of</strong> the<br />

said Letters to the Will with a List <strong>of</strong> Assizers names & designations that are to<br />

pass upon their assize and a list <strong>of</strong> the Witnesses names and designations that are<br />

to be adduced against them with a short Copy by way <strong>of</strong> charge Subjoined<br />

thereto Subserved by me both personally apprehended upon the said first day <strong>of</strong><br />

September and year foresaid which copies did bear the day and date here<strong>of</strong><br />

witnesses name & designations therein insert present thereat & hereto<br />

Subscribing Viz. James Gordon Messenger in Ayr & Wm Hogg Sheriff <strong>of</strong>ficer<br />

there.<br />

Charges read against Andrew & Ramsay<br />

Intran John Andrew Shoemaker in Maybole and Sometime Schoolmaster there<br />

and Robert Ramsay Cartwright there. Pannels Indicted and Accused at the<br />

instance <strong>of</strong> His Majesties Advocate for his Majesties Interests <strong>of</strong> the Crimes <strong>of</strong><br />

Sedition and administration <strong>of</strong> unlawful oaths in manner mentioned in the<br />

Criminal Lybell raised and prosecuted against them there anent bearing (here<br />

record the Criminal Letters).<br />

The libel being read over the panels pled not guilty.<br />

The Lord Justice Clerk having considered the Lybell against the Pannells<br />

Finds the same Relevant to infer the pain <strong>of</strong> Law; but allows the pannells a pro<strong>of</strong>
