1 THE CRITERION OF ``THE BEST INTERESTS OF THE CHILD''<br />

When considering <strong>the</strong> consequences of divorce in respect of <strong>the</strong> children,<br />

<strong>the</strong> general principle applies, namely that <strong>the</strong> best interests of <strong>the</strong> children<br />

should be <strong>the</strong> paramount concern. This principle is clearly embodied in <strong>the</strong><br />

Mediation in Certain Divorce Matters Act 24 of 1987 and section 6 of <strong>the</strong><br />

Divorce Act 70 of 1979, which are discussed below. Note that this
