Domestic violence is an all <strong>to</strong>o common occurrence in South Africa. To<br />

combat this problem, <strong>the</strong> Domestic Violence Act 116 of 1998 makes<br />

provision for protection orders with which persons who are in a domestic<br />

relationship can protect <strong>the</strong>mselves from domestic violence.<br />

LEARNING OUTCOMES<br />

After <strong>study</strong>ing <strong>the</strong> content of this <strong>study</strong> unit you should be able <strong>to</strong><br />

(1) indicate which remedy is created by <strong>the</strong> Domestic Violence Act 116 of<br />

1998<br />

(2) indicate that <strong>the</strong> Domestic Violence Act also applies <strong>to</strong> spouses in<br />

cus<strong>to</strong>mary and Muslim marriages, and <strong>to</strong> parties <strong>to</strong> a cohabitation<br />

relationship, including same-sex life partners<br />
