OVERVIEW<br />

Section II of Family Law is <strong>the</strong> first in which you <strong>study</strong> <strong>the</strong> actual content<br />

of <strong>the</strong> Family Law module. This section and all subsequent sections<br />

MUST BE STUDIED and not be merely read as in <strong>the</strong> case of section<br />

I. (There are, however, parts in section II that you merely have <strong>to</strong> read, but<br />

we shall expressly indicate where you may do so.)<br />

Marriage law is <strong>the</strong> field of family law which is discussed in this section.<br />

The discussion is divided in<strong>to</strong> five <strong>study</strong> units as follows:<br />

. Study unit 4 deals with <strong>the</strong> engagement which precedes marriage.<br />

. Study unit 5 explains <strong>the</strong> legal requirements for a valid marriage.<br />

. Study unit 6 deals with a particularly difficult aspect of <strong>the</strong> legal<br />

requirement of capacity <strong>to</strong> enter in<strong>to</strong> marriage, namely <strong>the</strong> marriage of<br />

a minor (who has limited capacity <strong>to</strong> act).<br />

. Study unit 7 covers void, voidable and putative marriages. In <strong>the</strong>se<br />

marriages one or more of <strong>the</strong> legal requirements for a valid marriage<br />

were not met.<br />

. Study unit 8 sets out <strong>the</strong> invariable consequences of marriage.<br />
