● transfers ownership of most public health care facilities to local governments<br />

● makes local governments responsible for supply<strong>in</strong>g primary and secondary care to the<br />

local population (territorial supply obligation) on the basis of the pr<strong>in</strong>cipal division of<br />

tasks (Article 8, section 4 and Article 70, po<strong>in</strong>t b) and the pr<strong>in</strong>ciple of subsidiarity<br />

(Article 69, section 2–6)<br />

● sets the scope of territorial supply obligation and the catchment area of service<br />

providers as the status quo, which can only be modified by an agreement between local<br />

governments concerned (Act XX of 1991, Article 132; for primary care Article 129,<br />

section 1 and Article 133, po<strong>in</strong>t l<br />

1. Act XI of 1991 on the National Public <strong>Health</strong> and Medical Officer Service (promulgated:<br />

09/04/1991) and Decree No. 7/1991. (IV. 26.) NM of the M<strong>in</strong>ister of Welfare on the<br />

Organisation and Operation of the National Public <strong>Health</strong> and Medical Officer Service<br />

● establishes the Service as a state agency on the basis of the former public hygiene<br />

stations, but tasks are def<strong>in</strong>ed accord<strong>in</strong>g to the concept of modern public health, and<br />

<strong>in</strong>clude the professional supervision of health care<br />

● def<strong>in</strong>es the structure and organs of the NPHMOS
