Data (promulgated: 05/06/1997)<br />

● protects confidentiality of personal <strong>in</strong>formation <strong>in</strong> health services<br />

4. Decree No. 12/1997. (VI. 5.) NM of the M<strong>in</strong>ister of Welfare on the Amendment of<br />

Decree No. 19/1996. (VII. 26.) NM on the M<strong>in</strong>imum Standards of Certa<strong>in</strong> Institutions<br />

Provid<strong>in</strong>g <strong>Health</strong> Services<br />

● extends the deadl<strong>in</strong>e by which providers have to meet m<strong>in</strong>imum standards<br />

5. Act XLVIII of 1997 on the Amendment of Various Acts <strong>in</strong> Connection with the<br />

Self Governance of Social Insurance (promulgated: 11/06/1997)<br />

● determ<strong>in</strong>es that self-governments not be elected and decreases the number<br />

of Provid<strong>in</strong>g Balneotherapy which is Subsidized by Social Insurance, and on the<br />

Adm<strong>in</strong>istration of these Social Insurance Subsidies<br />

7. Act LVIII of 1997 on Commercial Advertis<strong>in</strong>g (promulgated: 04/07/1997)<br />

● limits advertis<strong>in</strong>g on health damag<strong>in</strong>g products such as tobacco<br />

8. Act LXXX of 1997 on those Entitled for the Services of Social Insurance and Private<br />

Pensions and the Fund<strong>in</strong>g of these Services (promulgated: 25/07/1997) and its executive<br />

order of Government Decree No. 195/1997. (XI. 5.) Korm.<br />

● provides the rules for social <strong>in</strong>surance <strong>in</strong>clud<strong>in</strong>g compulsory participation (Article 2,<br />

section 1), entitlement for services and contribution rates<br />

● obligates the government to cover any deficit <strong>in</strong>curred by the HIF (Article 3, section 2)<br />

● stipulates that participation is compulsory for every citizen, <strong>in</strong>clud<strong>in</strong>g small farmers<br />

(Article 39, section 2), who can choose to pay a higher contribution to be eligible for<br />

● determ<strong>in</strong>es that the government transfer the revenue from the hypothecated health care<br />

tax to the HIF to compensate for non-contribut<strong>in</strong>g groups, such as pensioners, women<br />

on maternity leave, conscripts and the poor (Article 39, section 1 and Article 16,<br />

section 1, po<strong>in</strong>ts b-o)<br />

● further determ<strong>in</strong>es that contribution rates are to be determ<strong>in</strong>ed annually by the<br />

National Assembly (Article 19, contribution ceil<strong>in</strong>g – Article 24)<br />

● sets the m<strong>in</strong>imum level of the contribution base (Article 20, Section 2) and a ceil<strong>in</strong>g for<br />

employee contributions (Article 24, Section 2), calculated as twice the brutto monthly<br />

wages (5520 NCU per calendar day <strong>in</strong> 2000)<br />

● declares that medical services have to be paid for out-of-pocket by persons neither<br />

<strong>in</strong>sured nor entitled to medical services and when the free movement of persons<br />

regulation (1408//1/EC) does not apply, (Articles 19 and 39)<br />

● mandates the government to prepare recommendations for the National Assembly<br />

to ensure fiscal stability (Article 60)<br />

● dist<strong>in</strong>guishes between <strong>in</strong>sured persons, such as employed persons, members of<br />

cooperatives, apprentices <strong>in</strong> <strong>in</strong>dustrial tra<strong>in</strong><strong>in</strong>g, artisans, self-employed persons,<br />

<strong>in</strong>dependent farmers, perform<strong>in</strong>g artists, lawyers, and recipients of unemployment<br />

benefits and entitled persons, such as pensioners, beneficiaries of unemployment<br />

benefits, beneficiaries of social assistance benefits and allowances, beneficiaries of<br />

pensions provided by churches, full-time students who are Hungarian citizens resid<strong>in</strong>g
