Reflections on Open Scholarship Modalities <strong>and</strong> the Copyright Environment<br />

Seventh, all stakeholders should actively promote an underst<strong>and</strong>ing of<br />

the important implications of Copyright Management of scholarly works<br />

<strong>and</strong> encourage engagement with the development <strong>and</strong> implementation of<br />

Copyright Management tools to achieve the overarching objectives (SURF<br />

Foundation, n.d.).<br />

The proposed amendments (in fact supersession) of the Kenyan Copyright Act<br />

currently being considered by the relevant policy-makers will thus need to secure<br />

balance in two contexts so as to help realise an appropriate digital copyright<br />

regime (Ouma <strong>and</strong> Sihanya, 2010; Sihanya, 2012a, 2012b, 2013; cf. Mwakisyala,<br />

2000). There is need <strong>for</strong> balance between protection <strong>and</strong> access, <strong>and</strong> <strong>for</strong> balance<br />

between technological protection measures (TPMs), digital rights management<br />

(DRM) systems or rights management in<strong>for</strong>mation (RMI), on the one h<strong>and</strong>, <strong>and</strong><br />

market principles (or the price mechanism), social norms, copyright <strong>and</strong> related<br />

law, on the other (Sihanya, 2013b).<br />

5. Field research findings<br />

This report gives the findings based on the responses from four of the stakeholder<br />

groups surveyed: (1) authors of scholarly works, (2) publishers, (3) in<strong>for</strong>mation<br />

managers <strong>and</strong> (4) in<strong>for</strong>mation consumers. A separate questionnaire was prepared<br />

<strong>for</strong> each category surveyed. The questionnaires were designed to gather data on:<br />

motivation <strong>for</strong> publication of scholarly works by authors;<br />

rights in the scholarly work that the stakeholders, especially authors,<br />

consider most important;<br />

how the authors use scholarly works after publication;<br />

how the copyright policies of publishers affect authors;<br />

whether the stakeholders are familiar with the concepts of open scholarship<br />

<strong>and</strong> alternative publishing; <strong>and</strong><br />

how open scholarship is affecting the relationships among authors <strong>and</strong><br />

various stakeholders.<br />

The field research generated several main findings, as detailed in the subsections<br />

which follow.<br />

Motivation <strong>for</strong> authorship<br />

The 20 authors surveyed were based at public <strong>and</strong> private universities. Most of<br />

these authors have published books, journal articles, articles in peer-reviewed<br />

magazines, book chapters, course materials <strong>and</strong> related scholarly materials. The<br />
