appropriate, note and record any injuries sustained and note any<br />

relevant comments regarding the child’s health development and<br />

general welfare. Particular attention should be given to the child’s<br />

views at all times.<br />

8.2.3 Interviews should be arranged in a manner which causes the<br />

minimum possible distress to the child and should take account of<br />

issues such as age, gender, ethnic background and special needs.<br />

Whenever possible, children should have the opportunity to have a<br />

person present with whom they feel comfortable and who will provide<br />

the child with immediate support. This person can be anyone, but<br />

not the alleged abuser, and could include class teacher, or any other<br />

person seen as appropriate by the child, carer or Social Work<br />

Department.<br />

8.2.4 The Team Leader should discuss with police and relevant medical<br />

personnel and agreement should be reached on the following:<br />

• Whether or not a medical examination or medical<br />

assessment is required and what it is likely to achieve<br />

• What type of medical is required<br />

• Who should conduct the medical<br />

• Where it should be conducted<br />

• When it should be conducted<br />

N.B. ‘A person under the age of 16 years shall have legal<br />

capacity to consent on his own behalf to any surgical, medical<br />

or dental procedure where, in the opinion of a qualified medical<br />

practitioner attending him, he/she is capable of understanding<br />

the nature and possible consequences of the procedure or<br />

treatment’ (Age of Legal Capacity (Scotland) Act 1991)<br />

8.2.5 Having conducted the initial stages of an investigation, should the<br />

Social Worker have any concerns regarding the decision or practices<br />

of any other investigating agencies or any agencies consulted, they<br />

must discuss these immediately with the Team Leader/Service Unit<br />

Manager (<strong>Child</strong>ren and Families)<br />

8.2.6 In the event that a parent or person having parental responsibilities,<br />

care or control of a child, refuses to co-operate with any aspect of the<br />

investigation leading to concerns that the child’s welfare has not<br />

been properly looked after, then the Social Worker should discuss<br />

these concerns immediately with the Team Leader/Service Unit<br />

Manager (<strong>Child</strong>ren and Families) and careful consideration would<br />

need to be given as to whether or not a <strong>Child</strong> Assessment Order or<br />

<strong>Child</strong> <strong>Protection</strong> Order required to be applied for.<br />

8.2.7 Should a <strong>Child</strong> Assessment, <strong>Child</strong> <strong>Protection</strong> or Exclusion Order be<br />

required, this must be agreed in advance by the Service Unit<br />

Manager (<strong>Child</strong>ren and Families) (For full details regarding<br />
