3.17.4.2 Social workers must submit comprehensive applications on<br />

behalf of children who have been abused and who are<br />

looked after or accommodated. They must assist nonabusing<br />

parents make applications, where appropriate,<br />

when the child is not looked after or accommodated.<br />

3.17.4.3 A decision not to make an application must be made by the<br />

Service Unit Manager and he/she must record the reasons<br />

for this in the case file.<br />

3.17.4.4 The social worker must pass information on the application<br />

to the administrative officer responsible for the local<br />

database.<br />

3.17.5 When an award is offered<br />

3.17.5.1 The social worker should contact legal services<br />

immediately when an award is offered and seek advice on<br />

whether or not it should be accepted.<br />

3.17.6 Reconsideration, reviews and oral hearings<br />

3.17.7 Training<br />

3.17.6.1 Legal services should advise the social worker on how to<br />

proceed when it is felt that the decision should be<br />

reconsidered by the authority. In cases where an oral<br />

hearing is felt to be appropriate, legal services should<br />

assume responsibility for preparing the case, progressing<br />

the case and representation at oral hearing.<br />

3.17.6.2 Legal services should offer advice on whether or not there<br />

are grounds for judicial review and, if so, prepare and<br />

progress the application.<br />

3.17.7.1 Service Unit Managers must ensure that all staff attend<br />

relevant training to making and progressing applications.<br />

3.17.8 Legal services agency<br />

3.17.8.1 Legal Services Agency can provide staff training and adult<br />

clients can be referred directly for advice, guidance and<br />

representation.<br />
