CHILD PROTECTION AND CRIMINAL JUSTICE<br />
Introduction<br />
<strong>Child</strong> protection is a core principle for criminal justice services. There must be<br />
effective communication between child care and criminal justice staff.<br />
Some offenders can move between council areas and in and out of prison. This<br />
results in a need for co-ordination and management of information and consistency of<br />
approach, not only between councils but also between the councils, police, the prison<br />
service and other relevant agencies. Particular attention should be paid to prisoners<br />
who have committed a Schedule 1 offence in the past but whose current offence is not<br />
a Schedule 1 offence. These procedures apply to all offenders whose offending<br />
includes Schedule 1.<br />
Special programmes and appropriate accommodation for sex offenders are scarce<br />
resources. The aim must be to co-ordinate existing provision to maximum effect to<br />
ensure that risk assessment, monitoring and personal change programmes are<br />
informed by regular, timeous information exchange between all relevant agencies.<br />
<strong>Council</strong>s have statutory duties to provide social work services in the criminal justice<br />
system. Most are derived from Section 27 of the Social Work (Scotland) Act 1968 as<br />
amended by subsequent criminal justice legislation. The duties include:<br />
• social work services in the courts<br />
• social enquiry reports<br />
• restriction of liberty assessment<br />
• supervision orders made by courts - bail, probation, community service,<br />
supervised attendance, supervised release and short sentence licence<br />
• supervision of offenders released from prison on licence - life parole,<br />
determinate parole and non-parole<br />
• advice, guidance and assistance to prisoners who request it voluntarily within<br />
12 months of release from prison<br />
• support to families of offenders<br />
• throughcare to those sentenced to custody.<br />

Against <strong>Child</strong>ren. Circular No. SW/11/1994. The aim of the circular is to ensure an<br />
integrated approach to the management, assessment and provision of services for<br />
offenders convicted of offences against children and to ensure that services are<br />
considered for children who may be at risk.<br />
