3.15.7.35 Any involvement of a young person who is denying the<br />

offence(s) in a programme of work relating in any way to<br />

sexually abusive tendencies could potentially prejudice<br />

his/her future court case. The Service Unit Manager must<br />

discuss with the Procurator Fiscal any possibility of the<br />

young person being involved in a programme of direct<br />

work which relates to sexually abusive behaviour.<br />

3.15.7.36 In such instances the Service Unit Manager should advise<br />

the Procurator Fiscal and the Reporter in writing of this and<br />

seek advice and a speedy progression of the case.<br />

3.15.7.37 Young people who are admitting to the offences may agree<br />

to embark on a programme of work.<br />

3.15.7.38 Consideration should be given to securing a legal mandate<br />

to seek the young person's attendance at a programme of<br />

work designed to address his/her sexually abusive<br />

tendencies e.g. to attend as a condition of a probation<br />

order or supervision requirement.<br />

Young peoples' right to apply for criminal injuries compensation<br />

3.15.7.39 Young people who have been abused in residential care<br />

are entitled to apply for Criminal Injuries Compensation.<br />

(See Section 3.17)<br />

3.16 Allegations against Agency Employees<br />

3.16.1 When an allegation is made against a member of staff employed by a<br />

Statutory or voluntary agency, the paramount consideration will be<br />

the welfare of the child and these <strong>Procedures</strong> will apply, irrespective<br />

of the status of the alleged abuser.<br />

3.16.2 Each agency will have its own disciplinary procedures and will need<br />

to consider whether or not the employee in question should be given<br />

a precautionary suspension. All agencies have a duty of care to the<br />

employees and they will see that the employee is treated fairly and<br />

his/her rights respected. This includes giving adequate information<br />

and access to representation in any disciplinary or review<br />

proceedings. Always consult the police before interviewing a<br />

member of staff alleged to have abused a child.<br />

3.16.3 A particular consideration will be the identification of the investigating<br />

officers in relation to the employee and in all such cases the Service<br />

Unit Manager (<strong>Child</strong>ren and Families) will inform the Principal Officer<br />

(<strong>Child</strong>ren and Families and Criminal Justice) who will liaise with<br />

senior officers of other agencies as to how and by whom the<br />

investigation should be conducted.<br />
