How do I know if I am be<strong>in</strong>g harassed?<br />

An <strong>in</strong>dividual may or may not <strong>in</strong>tend to be harass<strong>in</strong>g you. What is important is<br />

the effect of their behaviour on you. The treatment might be on more than<br />

one ground, for example because you are a bisexual woman. If you feel that<br />

you are be<strong>in</strong>g harassed, the NUT will help you consider the circumstances<br />

which gave rise to that belief <strong>and</strong> advise you accord<strong>in</strong>gly.<br />

What should I do if I th<strong>in</strong>k I am be<strong>in</strong>g harassed?<br />

If you can, ask for the behaviour to stop. Keep notes of all <strong>in</strong>cidents of<br />

unwanted conduct, <strong>in</strong>clud<strong>in</strong>g dates, times, places, the names of any witnesses<br />

<strong>and</strong> your response to the behaviour. Offensive pupil behaviour should be<br />

reported under the pupil discipl<strong>in</strong>e procedure or <strong>in</strong> writ<strong>in</strong>g to your head<br />

teacher. You should <strong>in</strong>form your NUT representative who should contact your<br />

NUT regional office <strong>in</strong> Engl<strong>and</strong> or NUT Cymru <strong>in</strong> Wales. Your colleagues may<br />

have made similar compla<strong>in</strong>ts <strong>and</strong> you may be advised to tackle the issue<br />

jo<strong>in</strong>tly. The NUT urges all schools to adopt clear harassment <strong>and</strong> bully<strong>in</strong>g<br />

policies <strong>and</strong> procedures for deal<strong>in</strong>g with workplace harassment fairly <strong>and</strong><br />

quickly. Ask your NUT representative or your school office for a copy.<br />

The NUT will be able to advise you what steps you should take. You may be<br />

advised to deal with the matter <strong>in</strong>formally, for example by writ<strong>in</strong>g a letter to<br />

the <strong>in</strong>dividual ask<strong>in</strong>g for the behaviour to stop, or you may be advised to<br />

lodge a formal grievance. In rare cases you may be advised to take the<br />

matter to an employment tribunal. The objective <strong>in</strong> all cases will be to put a<br />

stop to the unwanted behaviour <strong>and</strong> allow you to cont<strong>in</strong>ue teach<strong>in</strong>g <strong>in</strong> a safe<br />

<strong>and</strong> professional environment.<br />

What should my employer do if I compla<strong>in</strong>?<br />

Your employer should fully <strong>in</strong>vestigate your compla<strong>in</strong>t <strong>and</strong> take appropriate<br />

action to stop further unwanted conduct.<br />

What if I'm afraid that the behaviour will get worse?<br />

The answer is to act promptly. Informal steps may resolve the matter quickly<br />

with m<strong>in</strong>imum disruption. On the other h<strong>and</strong>, formal proceed<strong>in</strong>gs may be<br />

necessary. The NUT will be able to advise you.<br />

You must not be treated less favourably because you have asserted your<br />

statutory rights by, for example, lodg<strong>in</strong>g a grievance. Your employer will be<br />

liable for subject<strong>in</strong>g you to such retaliation or punishment.<br />

Where can I f<strong>in</strong>d more <strong>in</strong>formation on harassment?<br />

You are urged to <strong>in</strong>form your NUT representative <strong>and</strong> NUT regional office <strong>in</strong><br />

Engl<strong>and</strong> or NUT Cymru <strong>in</strong> Wales if you feel harassed on grounds of your<br />

sexual orientation or on more than one ground, for example your sexual<br />

orientation <strong>and</strong> sex.<br />

harassment on grounds of race, sex, transgender status, disability, sexual<br />
