"(2) In determ<strong>in</strong><strong>in</strong>g whether material falls with<strong>in</strong> the prohibition PART IV<br />

regard shall be had to the content <strong>and</strong> style of the material, the time<br />

<strong>and</strong> other circumstances of publication <strong>and</strong> the likely effect on those<br />

to whom it is directed <strong>and</strong>, <strong>in</strong> particular, to the follow<strong>in</strong>g matters—<br />

(a) whether the material refers to a political party or to persons<br />

identified with a political party or promotes or opposes a<br />

po<strong>in</strong>t of view on a question of political controversy which<br />

is identifiable as the view of one political party <strong>and</strong> not of<br />

another;<br />

(b) where the material is part of a campaign, the effect which<br />

the campaign appears to be designed to achieve."<br />

(2) In section 4 of that Act (issue by Secretary of State of codes of<br />

recommended practice on publicity), <strong>in</strong> subsection (1) for the words from<br />

"for the guidance" to the end there shall be substituted "; <strong>and</strong> local<br />

authorities shall have regard to the provisions of any such code <strong>in</strong> com<strong>in</strong>g<br />

to any decision on publicity."<br />

(3) This section shall come <strong>in</strong>to force at the end of the period of two<br />

months beg<strong>in</strong>n<strong>in</strong>g with the day on which this Act is passed.<br />

28.—( 1) The follow<strong>in</strong>g section shall be <strong>in</strong>serted after section 2 of the Prohibition on<br />

Local Government Act 1986 (prohibition of political publicity)— promot<strong>in</strong>g<br />

homosexuality by<br />

Prohibition on 2A.—(l) A local authority shall not— teach<strong>in</strong>g or by<br />

promot<strong>in</strong>g (a) <strong>in</strong>tentionally promote homosexuality or publish publish<strong>in</strong>g<br />

material with the <strong>in</strong>tention of promot<strong>in</strong>g material.<br />

(b) promote the teach<strong>in</strong>g <strong>in</strong> any ma<strong>in</strong>ta<strong>in</strong>ed school of<br />

the acceptability of homosexuality as a<br />

(2) Noth<strong>in</strong>g <strong>in</strong> subsection (1) above shall be taken to<br />

prohibit the do<strong>in</strong>g of anyth<strong>in</strong>g for the purpose of treat<strong>in</strong>g<br />

or prevent<strong>in</strong>g the spread of disease.<br />

(3) In any proceed<strong>in</strong>gs <strong>in</strong> connection with the<br />

application of this section a court shall draw such<br />

<strong>in</strong>ferences as to the <strong>in</strong>tention of the local authority as may<br />

reasonably be drawn from the evidence before it.<br />

(4) In subsection (l)(b) above "ma<strong>in</strong>ta<strong>in</strong>ed school"<br />

means,—---<br />

(a) <strong>in</strong> Engl<strong>and</strong> <strong>and</strong> Wales, a county school, voluntary<br />

school, nursery school or special school, with<strong>in</strong><br />

the mean<strong>in</strong>g of the Education Act 1944; <strong>and</strong><br />

(b) <strong>in</strong> Scotl<strong>and</strong>, a public school, nursery school or<br />

special school, with<strong>in</strong> the mean<strong>in</strong>g of the<br />

Education (Scotl<strong>and</strong>) Act 1980."<br />

(2) This section shall come <strong>in</strong>to force at the end of the period of two<br />

months beg<strong>in</strong>n<strong>in</strong>g with the day on which this Act is passed.<br />

29.—(l) Schedule 3 to this Act (which relates to local government Local government<br />

adm<strong>in</strong>istration) shall have effect.<br />

(2) That Schedule shall come <strong>in</strong>to force at the end of the period of two<br />

months beg<strong>in</strong>n<strong>in</strong>g with the day on which this Act is passed.
