Excise gate pass Octroi receipts wherever applicable duly sealed indicating payments made; and 8. Any of the documents evidencing payment of statutory taxes. The above documents shall be received by the DEPARTMENT before arrival of the Goods (except deliver note and where it is handed over to the user with all documents) and if not received, the bidder will be responsible for any consequent expenses. 8.32. Insurance 1. It is suggested that the Item supplied under the contract shall be fully insured in a freely convertible currency against loss or damage incidental to manufacture or acquisition, transportation, storage, and delivery up to user site. The insurance should be for replacement value from “Warehouse to warehouse (final destination)” on “All Risks” valid upto 5 years till completion of delivery, installation and commissioning. 8.33. Transportation Transport of the goods to the project site(s) shall be arranged by the bidder at his cost. 8.34. Incidental services 1. The bidder may be required to provide any or all of the materials notifications and informations pertaining to project distribution by the bidder.: a. Performance or supervision or maintenance and/or repair of the supplied goods and services, for a period of time agreed by the parties, provided that this service shall not relieve the bidder of any warranty obligations under this Contract, and b. Training of Department or its nominated personnel, at the bidder's site and / or on-site, in assembly, start-up, operation, maintenance and/or repair of the supplied goods and services. c. Prices charged by the bidder for the preceding incidental services, if any, should be indicated separately ( if required), and should form part of the cost form. 8.35. Incidental Items 1. The bidder shall ensure availability of incidental items in stock at his nearest service centre for delivery within 24 hours,with specifications. 8.36. Service Levels : The Bidder should provide uninterrupted services for ensuring the setting up, managing and operating of system as per the requirements of this tender. Inability of the Bidder to either ensure deliverables as per specifications within defined timelines or to meet the APTS : One Stop-Shop Solution provider for e-Governance. Page: 66 of 124
apts RFP – Excise e-Governance Project (EeGP) for Prohibition & Excise Department Confidential and Proprietary service levels as specified in this RFP shall be treated as breach of contract and would invoke the penalty clause. The proposed rate of penalty with respect to non-adherence to service levels is mentioned in the RFP. Overall cap for penalties will be 10% of the contract value. Thereafter, the contract may be cancelled. Department will also have the right to invoke the performance guarantee. Penalties on delay will be applicable when the delay is not attributable to delays caused due to Government procedures or administrative delays. Notwithstanding anything contained above, no such penalty will be chargeable on the Bidder for the inability occasioned, if such inability is due to reasons entirely attributable to the administrative delays. Delivery of the Goods and performance of the Services shall be made by the Bidder in accordance with the time schedule specified by the Department. If at any time during performance of the Contract, the Bidder should encounter conditions impeding timely delivery of the Goods and performance of the Services, the Bidder shall promptly notify Department in writing of the fact of the delay, its likely duration and its cause(s). As soon as practicable after receipt of the Bidder’s notice, Department shall evaluate the situation and may at its discretion extend the Bidder’s time for performance, with or without liquidated damages, in which case the extension shall be ratified by the parties by amendment of the Contract. Any delay by the Bidder in the performance of its delivery obligations shall render the Bidder liable to the imposition of liquidated damages, unless extension of time is agreed upon without the application of liquidated damages. 8.37. Failure to agree with the Terms & Conditions of the RFP Failure of the successful bidder to agree with the Terms & Conditions of the RFP shall constitute sufficient grounds for the annulment of the award, in which event Department/APTS may award the contract to the next best value bidder as per this RFP or call for new proposals or invoke the EMD/PBG. 8.38. Disqualification The proposal is liable to be disqualified under the following cases: a. Proposal not submitted in accordance with this document. b. During validity of the proposal, or its extended period, if any, the bidder increases prices quoted in the commercial proposal. c. Proposal is received in incomplete form. d. Proposal is received after due date and time. e. The bidder qualifies the proposal with his own conditions f. Proposal is not accompanied by all requisite documents/EMD/Tender cost. g. Information submitted is found to be misrepresented, incorrect or false, accidentally, unwittingly or otherwise, at any time during the processing of the APTS : One Stop-Shop Solution provider for e-Governance.
