If any operational penalty, the same will be deducted before release of payment. 9.12 Payment Authority The Department will make the payment as per payment terms and conditions. a) The Department shall verify the IA’s statement and certify the amount to be paid to the IA after certify the software and hardware equipments. The Value of work completed shall be decided by the Department. b) The Department may exclude any item certified in a previous certificate or reduce the proportion of any item previously certified in any certificate in the light of later information. c) The payments as admissible shall be made after deducting the further security deposit, tax deduction at source (TDS), sales tax, royalty and other taxes applicable at prevailing rate at the time of payments. d) Payments to the IA shall be made only through cheques. e) The department will pay the IA 50% of the amount of the capital cost for the Software and Hardware certified by the Department as per the payment milestones specified in the above table after deducting penalty if any for the delay. Balance 50% of the capital cost will be paid in 20 equated quarterly installments i.e., on 1 st January, 1 st April and 1 st July, 1 st October after deducting penalty if any. f) The department will pay the IA balance 50% of the capital cost for successfully maintenance of Software and Hardware and certified by the Department in 20 equated quarterly installments after deducting penalty if any. The IA has to start the setup along with complete equipment within 30 days from the date LOI or 15 days from the Date of entering into contract agreement. In case the IA fails to start the work within this period, then the client shall be entitled in his opinion to levy the penalty at his discretion not exceeding Rs.10,000/- per day or part thereof. 2. If the IA fails to achieve the milestones as per the milestones mentioned in the RFP, then for every day of the delay in delivery of the deliverables then, the client at his discretion will levy a penalty of Rs.10,000/- per day or part thereof. 3. For every day of absence of staff, penalty will be 1.50 times of proportionate amount payable per day for each staff member Penalty for Operational & Change management: 1. If the IA fails to achieve the agreed time lines for every change request, then for every day of the delay in delivery of the deliverables then, the client at his discretion will levy a penalty of Rs.10,000/- per day or part thereof. 2. If any report generation is taking beyond 3 minutes, till the report is fine tuned in a week days from the date of written communication. If successful IA fails to achieve the report generation time, then for every day, the client at his discretion will levy a penalty of Rs.10,000/- per day or part thereof. 9.14 Taxes All quoted prices shall be inclusive of all taxes, duties, octroi, cess, royalty etc; and shall be held constant during the entire contract period 9.15 Price Adjustments Prices shall be held constant over a entire contract period Retention of money towards performance security a) As IAs submit the Performance Security before signing the contract, the department will not retain any percentage of the total value of the interim bill amount as stated in the SCC b) In case of failure of the IA to execute the entire contract the money retained as performance security will be forfeited and the remaining works shall be got executed by the Department at IA’s risk and cost. 9.16 Advance Payment No Advances will be paid 9.17 Insurance to men, machine and material The IA has to insure against all risks on his men, machine and material and provide the evidence before commencing the work to the client.
