Chapter Two<br />

Phase Two <strong>of</strong> the Research<br />

Phase One <strong>of</strong> the research focused on the exam<strong>in</strong>ation <strong>of</strong> files to assess the case<br />

process<strong>in</strong>g and case outcomes <strong>of</strong> youth <strong>in</strong> four juvenile court <strong>of</strong>fices. <strong>The</strong> primary focus<br />

was to exam<strong>in</strong>e the similarities and differences <strong>in</strong> the treatment <strong>of</strong> Blacks, Native<br />

American Indians, and other m<strong>in</strong>ority groups relative to Whites. <strong>The</strong> f<strong>in</strong>d<strong>in</strong>gs suggest that<br />

each <strong>of</strong> the four county juvenile court <strong>of</strong>fices differ to some degree <strong>in</strong> what factors<br />

<strong>in</strong>fluence decision mak<strong>in</strong>g. Common characteristics, however, are the presence <strong>of</strong> race<br />

and gender disparities <strong>in</strong> case outcomes at various stages <strong>in</strong> the proceed<strong>in</strong>gs. Most <strong>of</strong> the<br />

differences appear at <strong>in</strong>take, petition, and judicial disposition. Overall, m<strong>in</strong>orities <strong>in</strong> all<br />

four counties are more likely than whites to be placed <strong>in</strong> the state tra<strong>in</strong><strong>in</strong>g school.<br />

Because Phase One <strong>of</strong> the research relied on <strong>of</strong>ficial and un<strong>of</strong>ficial records at the juvenile<br />

court <strong>of</strong>fices, little could be said as to why this could be occurr<strong>in</strong>g.<br />

Phase Two <strong>of</strong> the research was conducted <strong>in</strong> an attempt to possibly answer why<br />

m<strong>in</strong>orities are disproportionately overrepresented <strong>in</strong> secure facilities. An analytical<br />

framework was <strong>in</strong>corporated to look at juvenile justice decision mak<strong>in</strong>g from a broad<br />

perspective. To accomplish this task, adult decision makers and youth <strong>in</strong> Black Hawk,<br />

Woodbury, Polk, and Scott counties were provided the opportunity to express their<br />

feel<strong>in</strong>gs on a variety <strong>of</strong> issues revolv<strong>in</strong>g around fairness, decision mak<strong>in</strong>g, case<br />

process<strong>in</strong>g, and case outcomes. <strong>The</strong> underly<strong>in</strong>g<br />
