likely that Julianus, as Rusticus, should be preferred over Atticus as <strong>the</strong> most likely<br />

possibility for AE 1953.237. If Julianus was <strong>in</strong>deed <strong>the</strong> figure referred to on AE<br />

1953.237, <strong>the</strong>n as a pagan, he may have been quite content to allow <strong>the</strong> Donatists as<br />

much leeway as possible with<strong>in</strong> <strong>the</strong> official and disapprov<strong>in</strong>g constra<strong>in</strong>ts that had<br />

existed towards that heresy s<strong>in</strong>ce Constant<strong>in</strong>e and with<strong>in</strong> <strong>the</strong> latest constra<strong>in</strong>ts due to<br />

<strong>the</strong>ir support of a rebel. 164 Evidently Valent<strong>in</strong>ian and his Consistory were also will<strong>in</strong>g,<br />

at times, to display flexibility to long-stand<strong>in</strong>g schismatics and <strong>the</strong>reby to reflect<br />

(conveniently) <strong>the</strong> attitude of <strong>the</strong> suggeren s. Valent<strong>in</strong>ian’s policy appears to have been<br />

much <strong>the</strong> same as that adopted by Constant<strong>in</strong>e after 314 and his failure to surpress<br />

<strong>the</strong>m; that is to leave <strong>the</strong> Donatists to <strong>the</strong>ir own devices, but never<strong>the</strong>less, if<br />

Valent<strong>in</strong>ian had been <strong>in</strong>tolerant towards <strong>the</strong>m, ra<strong>the</strong>r than of a similar attitude as<br />

Julianus, we may at least have expected a display of rhetorical <strong>in</strong>vective, if not some<br />

provision for punishment as Valent<strong>in</strong>ian had applied to <strong>the</strong> Manicheans. 165 The<br />

absence of such at this time, dur<strong>in</strong>g a revolt which <strong>the</strong> Donatists were apparently<br />

support<strong>in</strong>g, is certa<strong>in</strong>ly evidence of a remarkable degree of tolerance on Valent<strong>in</strong>ian's<br />

part.<br />

An order for <strong>the</strong> protection of graves was made to Eu<strong>the</strong>rius which has<br />

survived only because it was recorded on an <strong>in</strong>scription <strong>in</strong> Rome. 166 From its<br />

provisions however, it seems likely that <strong>the</strong> order would have been <strong>in</strong>cluded <strong>in</strong> <strong>the</strong><br />

Code, but <strong>in</strong> all probability <strong>the</strong> commissioners appear to have accidentally missed it.<br />

Unfortunately it is not possible to provide even an approximate date for <strong>the</strong><br />

<strong>in</strong>scription; <strong>the</strong> half that gave <strong>the</strong> emperors’ names is lost leav<strong>in</strong>g just <strong>the</strong> titular<br />
