evealed a bigger plot by an ex governor Fidustius and o<strong>the</strong>r senior members of <strong>the</strong><br />

government, to discern <strong>the</strong> name of Valens’ successor through “<strong>the</strong> abom<strong>in</strong>able art of<br />

div<strong>in</strong>ation <strong>in</strong> secret.” 210 The conspirators found <strong>the</strong> successor to be Theodorus, <strong>the</strong><br />

deputy head of <strong>the</strong> n otarii, who was summoned from Constant<strong>in</strong>ople and executed<br />

along with o<strong>the</strong>rs; some victims had <strong>the</strong>ir property confiscated and suffered exile.<br />

Ammianus claims that <strong>the</strong> victims <strong>in</strong>cluded both <strong>the</strong> guilty and <strong>the</strong> <strong>in</strong>nocent. 211<br />

Ammianus describes <strong>the</strong> nature of <strong>the</strong> div<strong>in</strong>ation ritual as revealed dur<strong>in</strong>g <strong>the</strong> trial as<br />

<strong>in</strong>vok<strong>in</strong>g “<strong>the</strong> div<strong>in</strong>e power which presides over prophecy” ra<strong>the</strong>r than as astrology<br />

itself, 212 and both Mat<strong>the</strong>ws and Lenski refer to <strong>the</strong> ceremony as <strong>in</strong>volv<strong>in</strong>g a ouija<br />

board through which <strong>the</strong> name of <strong>the</strong> next emperor was revealed. 213 Unfortunately,<br />

<strong>the</strong>refore CTh 9.16.8 is probably not a direct response to this elite conspiracy aga<strong>in</strong>st<br />

Valens; if it were, <strong>the</strong>n it would have been focused on div<strong>in</strong>ation. At best, it can be<br />

reasonably said that CTh 9.16.8 is consistent with <strong>the</strong> prevail<strong>in</strong>g atmosphere and may<br />

reasonably be viewed as one measure, probably amongst many, to curb <strong>the</strong> general<br />

sort of dubious magic with which <strong>the</strong> conspirators were engaged.<br />

However if this law can be l<strong>in</strong>ked with any specific event recorded <strong>in</strong> <strong>the</strong><br />

sources, <strong>the</strong>n <strong>the</strong> most likely <strong>in</strong>cident must be one briefly referred to by Ammianus.<br />

An unnamed, but “respectable citizen” was discovered to have a copy of a horoscope<br />

belong<strong>in</strong>g to someone called Valens, whom <strong>the</strong> “respectable citizen” claimed was his<br />

long dead bro<strong>the</strong>r. Ammianus records that <strong>the</strong> bro<strong>the</strong>r claimed to be able to prove<br />

this, but was tried and executed before he could do so <strong>in</strong> c372. 214 The authorities<br />

possibly had good grounds to be suspicious; <strong>the</strong> accused’s bro<strong>the</strong>r had been dead for<br />

some time and so <strong>the</strong>refore <strong>the</strong> question of why should <strong>the</strong> bro<strong>the</strong>r have kept a<br />

horoscope belong<strong>in</strong>g to a dead person may well have arisen. Alternatively, <strong>the</strong><br />

horoscope could have <strong>in</strong>dicated <strong>the</strong> actual death of <strong>the</strong> bro<strong>the</strong>r and thus was evidence<br />
