seat.” 85 With admirable subtlety, Constant<strong>in</strong>e had shown that merely by petition<strong>in</strong>g<br />

him with appeals, that itself <strong>in</strong>dicated <strong>the</strong> wickedness of <strong>the</strong> Donatists: “those<br />

slanderers of religion , who refus<strong>in</strong>g <strong>the</strong> judgement of heaven [presumably <strong>the</strong> <strong>Later</strong>an<br />

and Arles decisions] have thought fit to demand my judgement? Is that what <strong>the</strong>y<br />

th<strong>in</strong>k of Christ our Saviour?” 86 The Catholic clerics could not have wished for a<br />

greater enhancement of <strong>the</strong>ir status. Constant<strong>in</strong>e had abdicated responsibility for<br />

decision-mak<strong>in</strong>g <strong>in</strong> one sphere of life and, <strong>the</strong>reby, <strong>in</strong> voluntarily cast<strong>in</strong>g aside one<br />

facet of his power and authority, had enhanced his piety and prestige even fur<strong>the</strong>r.<br />

In his clos<strong>in</strong>g sentences, Constant<strong>in</strong>e stated that although <strong>the</strong> Donatists were<br />

“openly convicted of <strong>the</strong>se th<strong>in</strong>gs, you who follow <strong>the</strong> way of <strong>the</strong> Lord must none <strong>the</strong><br />

less exercise patience, giv<strong>in</strong>g <strong>the</strong>m even now <strong>the</strong> choice of what <strong>the</strong>y th<strong>in</strong>k should be<br />

preferred. 87 Doubtless this <strong>request</strong> was made <strong>in</strong> order to rem<strong>in</strong>d <strong>the</strong> Catholics of <strong>the</strong><br />

necessity of keep<strong>in</strong>g <strong>the</strong> peace. At <strong>the</strong> same time, Constant<strong>in</strong>e <strong>in</strong>formed <strong>the</strong>m of his<br />

orders to <strong>the</strong> African Vicar to send “men of a like <strong>in</strong>sanity to my court immediately,” 88<br />

as such, Constant<strong>in</strong>e was evidently <strong>in</strong>form<strong>in</strong>g <strong>the</strong> clerics that he ma<strong>in</strong>ta<strong>in</strong>ed an <strong>in</strong>terest<br />

<strong>in</strong> <strong>the</strong> matter and that any ‘breaches of <strong>the</strong> peace’ would be reserved to himself.<br />

Constant<strong>in</strong>e was h<strong>in</strong>t<strong>in</strong>g that whilst <strong>the</strong> clerics’ word on matters of religion was f<strong>in</strong>al,<br />

Constant<strong>in</strong>e, as <strong>the</strong> secular arm would enforce <strong>the</strong> verdict of <strong>the</strong> Church.<br />

Early <strong>in</strong> <strong>the</strong> next year, <strong>in</strong> February 315 <strong>the</strong> proconsul Aelian f<strong>in</strong>ally published<br />

his verdict on Felix of Abthungi and declared him to be <strong>in</strong>nocent of be<strong>in</strong>g a traditor<br />
