CTh. 16.7.2 of 20 May 383 was addressed to Postumianus, a Christian. 279 This<br />

law is longer and more complicated than <strong>the</strong> previous, but essentially repeated <strong>the</strong><br />

provisions of that previous, with some concessions. It stated that “Christians and<br />

those confirmed <strong>in</strong> <strong>the</strong> faith [who] have turned to pagan rites and cults” were to be<br />

denied “all power to make a testament <strong>in</strong> favour of any person whatsoever, so that<br />

<strong>the</strong>y shall be outside <strong>the</strong> <strong>Roman</strong> law.” 280 If, however “Christians and catechumens”<br />

who were “neglect[<strong>in</strong>g] <strong>the</strong> venerable religion and go[<strong>in</strong>g] over to altars and temples”<br />

<strong>the</strong>n <strong>the</strong>y were forbidden to bequeath property to anyone except <strong>the</strong>ir statuary heirs,<br />

i.e. <strong>the</strong>ir children and bro<strong>the</strong>rs. 281<br />

The law went on to deal with <strong>in</strong>heritances, and this section is less clear. It<br />

ordered that “<strong>the</strong> same general rule shall be observed with respect to <strong>the</strong>ir persons <strong>in</strong><br />

tak<strong>in</strong>g property under a will” so that <strong>the</strong>y may not <strong>in</strong>herit “except for <strong>the</strong>ir own<br />

successions and statutory ones.” F<strong>in</strong>ally <strong>the</strong> law ended with a clause that such people<br />

“must unquestionably be excluded from all power not only to make testaments but<br />

also to enjoy <strong>the</strong>m under any right of acquir<strong>in</strong>g an <strong>in</strong>heritance.” 282<br />

In its first section, this law prevented apostatised baptised Christians from<br />

mak<strong>in</strong>g a will at all and <strong>the</strong>n went on to restrict <strong>the</strong> bequeath<strong>in</strong>g rights of Christians<br />

who were catechumens, but unbaptised, from bequeath<strong>in</strong>g to anyone except members<br />

of <strong>the</strong>ir immediate family. The second section may have been <strong>in</strong>tended to apply <strong>the</strong>se<br />

same rules to such apostates apropos <strong>in</strong>herit<strong>in</strong>g, but that is not altoge<strong>the</strong>r clear <strong>in</strong> this<br />
