3.4.4 Emergency Response Management by Authorities<br />

RECOMMENDATION<br />

Member Countries should ensure that there is an adequate national authority responsible for<br />

responding to navigational emergencies <strong>along</strong> the waterway.<br />

Challenge<br />

The government’s role, which may assume many different facets, is a very important factor in the<br />

maritime transport industry. The government influences <strong>and</strong> controls the industry in many different<br />

ways <strong>and</strong> to different extents through legal, political <strong>and</strong> financial instruments.<br />

To manage inl<strong>and</strong> waterways, ports, terminals <strong>and</strong> their traffic, a legal framework is necessary that<br />

should result in the establishment <strong>of</strong> different governmental agencies. Only in Viet Nam does such a<br />

framework exists, although implementation <strong>and</strong> control <strong>of</strong> the existing regulations is either not possible<br />

or not efficient due to various reasons such as budget constraints.<br />

Government agencies such as inl<strong>and</strong> water authority, coast guards <strong>and</strong> port authorities can<br />

issue amend, promulgate <strong>and</strong> enforce regulations. Through powers vested in their constitutions,<br />

governments exercise authority <strong>and</strong> control over dangerous goods transport, safety <strong>and</strong> health<br />

<strong>and</strong> environmental protection. This includes emergency response management. The degree <strong>of</strong><br />

independence/interdependence, cooperation <strong>and</strong> responsibility <strong>of</strong> competent authorities within their<br />

areas <strong>of</strong> responsibility, which should be regulated by law, may vary between countries.<br />

Emergency response by authorities is only possible if the necessary agencies exist <strong>and</strong> are fully<br />

operational.<br />

Institutional <strong>and</strong> Capacity Building<br />

Emergency responses can be divided into national response by inl<strong>and</strong> waterway authorities <strong>and</strong> local<br />

responses by port authorities restricted to the limits <strong>of</strong> the port.<br />

Inl<strong>and</strong> Waterway Authorities<br />

Inl<strong>and</strong> waterway authorities, which may be known as coast guards, should be national emergency<br />

organisations <strong>and</strong> may be a part <strong>of</strong> the ministry responsible for transport. Their purpose should be<br />

to establish, promote <strong>and</strong> enforce safety <strong>and</strong> security st<strong>and</strong>ards <strong>and</strong>, by doing so, prevent as far as<br />

possible the loss <strong>of</strong> life at sea <strong>and</strong> on inl<strong>and</strong> waters, <strong>and</strong> to provide effective emergency response<br />

services <strong>and</strong> to safeguard the quality <strong>of</strong> the marine or freshwater environment. The objective in<br />

relation to water pollution is to develop <strong>and</strong> coordinate an effective regime for preparedness <strong>and</strong><br />

response to spills <strong>of</strong> oil <strong>and</strong> other hazardous substances from vessels, to provide an efficient <strong>and</strong><br />

effective response to incidents involving casualties <strong>and</strong> to monitor/intervene in salvage operations,<br />

Such authorities can also be responsible for monitoring vessel traffic, security <strong>and</strong> illegal drug<br />

trafficking. In practice, this means that they are responsible for:
