5.3.9 Coordinate Draft Rules <strong>and</strong> Regulations in Cambodia<br />

RECOMMENDATION<br />

The draft Cambodian rules <strong>and</strong> regulations on dangerous goods should be coordinated with the<br />

existing Vietnamese rules <strong>and</strong> regulations on dangerous goods on the basis <strong>of</strong> the Cambodia-Viet<br />

Nam Agreement on Waterway Transportation.<br />

CHALLENGE<br />

The MPWT in Cambodia is currently drafting the Law on Inl<strong>and</strong> Water Transport <strong>and</strong> a Draft Prakas on<br />

technical requirements for the transport <strong>of</strong> dangerous goods in Cambodia.<br />

Rules <strong>and</strong> regulations in Viet Nam for transport <strong>of</strong> dangerous goods should be considered prior to<br />

implementing the national regulations in Cambodia in order to enable st<strong>and</strong>ards to be harmonised.<br />

Furthermore, it is to be noted that the 2009 Agreement on Waterway Transportation specifically<br />

instructs the Mekong Navigation Facilitation Committee (MNFC) in Cambodia <strong>and</strong> Viet Nam to make<br />

proposals for the adoption by the Contracting Parties <strong>of</strong> harmonised rules <strong>and</strong> regulations on the<br />

transportation <strong>of</strong> dangerous goods.<br />

5.3.10 Review Draft Rules <strong>and</strong> Regulations in Lao PDR<br />

RECOMMENDATION<br />

Draft rules <strong>and</strong> regulations for safe transport <strong>of</strong> dangerous goods in Lao PDR should be reviewed.<br />

CHALLENGE<br />

Lao PDR is currently drafting rules <strong>and</strong> regulations for the carriage <strong>and</strong> h<strong>and</strong>ling <strong>of</strong> dangerous goods. It<br />

will be important to ensure that the rules <strong>and</strong> regulations consider the Lancang-Mekong Agreement as<br />

well as the priority areas for ports, ferry crossings <strong>and</strong> cargo vessels which were identified in Volume I<br />

(Risk Analysis). The rules <strong>and</strong> regulations should be integrated with road <strong>and</strong> rail networks to improve<br />

the safety <strong>and</strong> efficiency <strong>of</strong> multimodal transport in the future.<br />

As already mentioned, there is currently no up-to-date legal regime for the stretch <strong>of</strong> the Mekong<br />

between Luang Prabang <strong>and</strong> Khone Falls. If Lao PDR <strong>and</strong> Thail<strong>and</strong> would conclude a new agreement<br />

with regard to this stretch, this agreement needs to be taken into account as well.<br />

Furthermore, it can be noted that capacity-building through training, seminars <strong>and</strong>/or workshops is<br />

needed in order to ensure that draft rules conform to existing international st<strong>and</strong>ards.<br />

5.3.11 Study Existing Rules <strong>and</strong> Regulations in Thail<strong>and</strong><br />

RECOMMENDATION<br />

The possibility to enact or improve laws <strong>and</strong> regulations on transportation <strong>of</strong> dangerous goods in<br />

Thail<strong>and</strong> which focus on inl<strong>and</strong> waterway transportation should be studied.<br />

CHALLENGE<br />

As confirmed by the findings <strong>of</strong> the National Working Group in the risk register, there is almost no<br />

legislation concerning the carriage <strong>of</strong> dangerous goods in Thail<strong>and</strong> for the Mekong River. The possibility
