acceptance of non-‐neutral 86 arbitrators as it happ<strong>en</strong>s in domestic arbitrations in the United <br />
States. <br />
The interesting point of this proposal is that, ev<strong>en</strong> though it jumps to the other side of the <br />
equation, it gives a clear solution to the hypocrisy problems that party appointed <br />
arbitrators pres<strong>en</strong>t in some cases. This proposal might require some reforms as well, but <br />
the big differ<strong>en</strong>ce is that these do not contemplate any prohibition, and would allow the <br />
parties to retain some control on the formation of the Tribunal. <br />
Concluding remarks <br />
The arbitration Agreem<strong>en</strong>t establishes the main factor to be tak<strong>en</strong> into account in any <br />
arbitration proceeding. It is under the agreem<strong>en</strong>t to arbitrate that i will be possible to <br />
determine the proper constitution of a particular Arbitral Tribunal for a specific dispute. <br />
H<strong>en</strong>ce, it can be said that the constitution of the arbitral tribunal is a crucial mom<strong>en</strong>t, <br />
where the agreem<strong>en</strong>t made by the parties needs to be respected and <strong>en</strong>forced in differ<strong>en</strong>t <br />
aspects such as: the number of arbitrators, appointm<strong>en</strong>t method selected, qualities <br />
required in arbitrators, place of arbitration, set of procedural rules, among other factors. <br />
The failure in the establishm<strong>en</strong>t of a Tribunal in accordance to the parties agreem<strong>en</strong>t, or <br />
that performs in an impartial, indep<strong>en</strong>d<strong>en</strong>t and neutral manner, can lead to dreadful <br />
results. Either by having an award that is going to be set aside or ev<strong>en</strong> worse, by having an <br />
unjust award that can be <strong>en</strong>forceable all over the world. <br />
The personal traits, ethical values, and capacity of each of the arbitrators will be <br />
determinant in the creation of an <strong>en</strong>vironm<strong>en</strong>t of cooperation and harmony in the <br />
Activities of the Tribunal. The success of the creation of such <strong>en</strong>vironm<strong>en</strong>t will be reflected <br />
in the quality of the conduct of the proceedings, and, ultimately, in the award. <br />
